KSAMC Encourages Adherence to Issuing of Stop Notices
Following observation by a member of the Technical Team of the Kingston and St. Andrew Municipal Corporation (KSAMC), and subsequent complaints regarding the presence of a concrete mix truck pouring concrete, on Friday, September 20, 2024, at premises located at 8 Holborn Road in New Kingston, the KSAMC conducted a site inspection of the location on even date.
Upon arrival, the team of officers observed the pouring of concrete mix, and that construction was in progress on a multi-storey building. This resulted in a Stop Notice being served at the location for ‘Construction without valid Building Permit’.
It must be noted that an application was made for building construction, and permit granted. However, this permit expired and was not subsequently renewed by the developers.
While the pouring of concrete and the partial blocking of roads are sometimes unavoidable, the KSAMC is requesting that developers put proper traffic management systems in place to prevent the total obstruction of traffic, especially on major thoroughfares during peak hours. The KSAMC further recommends that these activities are carried out on Saturdays, and or that the assistance of the police be sought to assist with traffic management to prevent possible congestion, when these activities are in progress.
The KSAMC also uses this opportunity to remind developers that each Building Permit is for a set time, therefore, if the construction is not completed within this time, an application for renewal must be made for an extension of time in which to complete said construction.
Members of the public are also reminded that failure to comply with a STOP NOTICE commits an offense and shall be liable on conviction in a Parish Court to a fine of not less than 3% nor more than 10% of the estimated construction cost of the building work, but in any event not exceeding five million dollars, and in default of payment, to imprisonment for a term not exceeding four (4) years.
On conviction of indictment in the Supreme Court to a fine in an amount that is not less than 3% nor more than 10% of the estimated construction cost of the building work, in default of payment, to imprisonment for a term not exceeding four (4) years.
Failure to comply with a Stop Notice may be discharged by payment of a fixed penalty in the amount of $1,500,000.00.
